ABC Company 401(k) Savings Plan

Eligibility Requirements:

To be eligible to participate, employees must meet the following criteria: You must be at least 21 years old. You must have completed one year of service. A year of service is defined as 1,000 hours of work during the course of a year.
You are eligible to rollover assets from a former employer's qualified plan immediately upon employment.

Effective Date:

The plan year is the 12-month period beginning on January 1 each year and ending on December 31. Records for the plan are kept on a plan year basis.

Enrollment Dates:

You may enroll in the plan on the first business day of the month following meeting your eligibility.

Your Contributions:

You may contribute up to 5 % directly from your gross pay on a before-tax basis. You can change your percentage contribution quarterly. The annual limit you can contribute to your plan is $10,500. Salary deferral contributions are permitted up to the annual maximum allowed by the IRS. Changes to your after-tax contributions can be made quarterly.

Employer Contributions:

For each $1.00 that you contribute, up to 10% of your compensation, your employer will contribute 15% of your eligible earnings up to the first $10,000. The maximum annual amount of your employer's match is $10,000. Your Employer may match a percentage of your salary deferral contribution to be determined each year. To be eligible to receive matching contributions, employees must meet the following criteria:

  • You must be 21 years old
  • You must have completed 1,000 hours of service
  • You must be employed on the last calendar day of the year
  • The following groups of employees will be excluded:

  • Nonresident Aliens
  • Hourly Workers

    A secondary match of $0.10 on the dollar will me made on behalf of those employees who earn less than $30,000 annually.
  • Profit Sharing:

    Your employer may make a discretionary annual profit sharing contribution of 5% of your salary on your behalf. To be eligible to receive profit sharing contributions, employees must meet the following criteria:

  • You must be 21 years old
  • You must have completed 1,000 hours of service
  • You must be employed on the last calendar day of the year

    Employees formerly employed by ABC affiliates are eligible for profit sharing immediately upon employment.
  • Vesting:

    Vesting refers to the rate at which you receive ownership in employer contributions. You are always 100% vested in the value of your own salary deferral contributions and any earnings on those contributions.

    Your employer offers immediate vesting of its matching contributions.

    Your employer's matching contributions become vested at the following rate:

  • Year 1: 15% Vested
  • Year 2: 30% Vested
  • Year 3: 60% Vested
  • Year 5: 100% Vested
  • Borrowing Money From Your Account:

    You may borrow money from your account. The minimum loan amount is $1,000. The minimum number of loans permitted at any one time is 2. The maximum amount you may borrow is ½ of your vested balance up to the maximum of $50,000.

    Loans are only available in the event of a financial hardship

    Loans may only be taken from amounts contributed through salary deferral.

    Withdrawing Money From Your Account:

    You are permitted to receive distributions from your account in the following circumstances:

  • Normal Retirement
  • Financial Hardship
  • Separation from Service
  • Disability
  • Death

    After-tax contributions may be distributed as needed.

  • Investment Direction:

    Allocation among your investment choices must be made in 6% increments. Current invested account balances can be reallocated quarterly. The participant may change the investment direction of future contributions quarterly.

    Investment allocation modifications may be made via the Voice Response Unit and/or the Internet site.
